Public Offer
This document is the public offer of the Klen VPN service (the “Provider”). It contains all terms of the agreement for access to the Klen VPN service (the “Agreement”) and is addressed to anyone who wishes to use the service (the “User”).
1. Definitions
- Service — the Provider’s hardware and software system that gives the User a secure (encrypted) network connection between the User’s device and the Provider’s server.
- Access — the right to use the Service during the paid Period, provided as a subscription link and/or a connection key.
- Period — the paid access term: 1, 3 or 12 months (30, 90 or 365 calendar days) depending on the selected plan.
- App — third-party client software (for example, Happ) that the User installs on their own to connect to the Service. The App is not part of the Service and does not belong to the Provider.
- Website — https://klenvpn.com and its mirrors.
2. Acceptance
- Payment for Access is full and unconditional acceptance of this offer. The Agreement is concluded at the moment of payment.
- By paying for Access, the User confirms that they have reached the age of majority under the laws of the country where they are located, are entitled to enter into such agreements, and have read and accept this offer, the Terms of Use and the Privacy Policy.
- The User checks on their own whether use of the Service is permitted in the country where they are located and does not use the Service where it is prohibited.
3. Subject of the Agreement
- The Provider gives the User Access to the Service for the selected Period, and the User pays for it.
- The purpose of the Service is to protect transmitted data from interception by encrypting the connection.
- Access parameters: unlimited traffic volume; up to 5 devices connected at the same time. The Provider determines server locations, addresses and protocols and may change them without degrading the stated parameters.
- The Provider only provides the technical means of a secure connection and is not the owner, operator or distributor of the information the User accesses through the Service, does not choose the recipients of that information and does not influence its content.
- The Provider does not guarantee the availability of specific third-party websites, services or applications: their operation depends on those third parties, telecom operators and other circumstances beyond the Provider’s control.
4. Price and payment
- The price of Access is shown on the Website at the time of payment: 1 month — 299 ₽, 3 months — 699 ₽, 12 months — 2,499 ₽. The price with a promo code is calculated by the Website before payment.
- Payment is made once through a payment agent. There are no automatic recurring charges.
- The payment obligation is fulfilled when the payment agent confirms the payment. Fees charged on the User’s side by a bank, payment service or blockchain network (if any) are paid by the User.
- Price changes on the Website do not affect Periods that have already been paid.
5. Provision of services
- Access is provided automatically right after the payment is confirmed: the subscription link is shown on the Website.
- The service of providing Access is deemed properly rendered from the moment the subscription link is provided, unless the User reports within the term set in section 8 that they are unable to connect.
- Paying again with the same contact extends Access by a new Period, which is added to the unexpired one.
- The Provider may carry out maintenance, notifying the User in advance where possible. Interruptions caused by failures at telecom operators, hosting providers and other third parties, or by actions of government authorities of any country, are not a breach of the Agreement by the Provider.
6. User obligations and liability
- The User uses the Service for lawful purposes only and complies with the laws of the country where they are located and the country from which they access the Service.
- The User may not use the Service to:
- access information whose distribution is prohibited or restricted by the laws applicable to the User;
- send spam, distribute malware, commit fraud, gain unauthorized access to other people’s information, carry out DDoS attacks or other unlawful actions;
- infringe the rights of third parties, including intellectual property rights;
- resell Access or share it with third parties beyond the device limit.
- The User is solely and fully responsible for all actions performed with their subscription link or key, for the content of information they send and receive, for the lawfulness of their actions online, and for keeping the subscription link and key safe.
- The User chooses, installs and configures the App on their own and is responsible for the compatibility of their hardware and software.
- The User compensates the Provider for losses caused by a breach of this section, including fines, third-party claims and other expenses incurred by the Provider through the User’s fault.
7. Provider’s rights
- The Provider may suspend Access for the duration of a review if there are reasonable signs of a breach of section 6, including upon receiving complaints from third parties.
- If a breach of section 6 is confirmed, the Provider may terminate Access and the Agreement unilaterally. In this case the price of the unused part of the Period is refunded minus the losses caused to the Provider by the breach.
- The Provider may refuse to provide Access without giving reasons, refunding the payment received.
8. Refunds
- If the User was unable to connect to the Service for reasons attributable to the Provider, they may request a refund of the full price of Access within 7 calendar days of payment.
- In other cases the User may withdraw from the Agreement at any time; they receive a refund of the unused part of the Period (in proportion to the remaining days) minus the payment agent’s fees and other expenses actually incurred by the Provider.
- How to submit a request is described in the Refund Policy.
9. Limitation of liability
- The Service is provided “as is” and “as available” with the parameters stated in clause 3.3. The Provider does not guarantee a particular connection speed, uninterrupted 24/7 operation, or operation of the Service on the networks of specific telecom operators or in specific countries.
- The Provider is not liable for:
- the content, lawfulness and availability of third-party websites, services and information;
- the User’s actions and their consequences, including measures taken against the User by the authorities of any country;
- the operation of the App and other third-party software, the User’s equipment and networks;
- restrictions imposed by telecom operators, resource owners and government authorities;
- the User losing the subscription link or passing it to third parties;
- indirect losses, lost profits or loss of data.
- The Provider’s total liability under the Agreement is limited to the price of the paid Period.
- The limitations in this section apply to the maximum extent permitted by applicable law. If a limitation cannot be applied to the User due to mandatory rules, it applies to the extent permitted.
- The parties are released from liability for failure to perform obligations due to force majeure, including failures of communication and power networks, cyberattacks and acts of government authorities.
10. Term and changes
- The Agreement is valid until the end of the paid Period and, as regards settlements, until they are completed.
- The Provider may change this offer by publishing a new version on the Website. The new version applies to Agreements concluded after its publication; for Periods already paid, the terms in effect on the payment date apply.
- If any provision of this offer is held invalid, the remaining provisions remain in force.
11. Disputes
- The parties settle disagreements through negotiation. Requests and claims are sent to klenvpn@outlook.com; the Provider responds within 10 business days.
- Disputes not settled through negotiation are resolved in the manner established by applicable law.
